Are Ballot Selfies Legal In Wisconsin?

America's big election is less than a month away.

If you've checked social media at all in the last few years, you've probably seen at least one of your friends post something alluding to which political party they plan to vote for. And as with every election since probably 2012, did you actually vote if you didn't take a selfie at the polling station?

And now early voting is on the docket and we're getting stuff in the mail about it. If you really want to post your ballot on social media and let the planet know who you voted for, can you?

Wisconsin's Take On Ballot Selfies

According to Yahoo News, for the 2024 election, ballot selfies are kinda legal in Wisconsin.

You can take a selfie in the voting booth or with the 'I Voted' sticker, or even with your actual ballot. But it cannot show who you voted for. It has to be an unmarked ballot.

It's A Problem, Just Ask The Official Who Got In Trouble

A Wisconsin man from Mequon had charges dropped against him last year after he posted a selfie with his marked ballot in the April 2022 election.

He was facing a maximum 3.5 years in jail and $10,000 in fines. If convicted, he would have also been barred from holding an elected office.

Yikes. Not worth it.

Charges were dropped because a judge ruled that the state's law prohibiting pictures with marked ballots goes against the constitutional right of freedom of speech. Like with Illinois, there's probably a reason for the law. They don't want you to post pics of a marked ballot because they want to deter shady vote-buying (so posting the ballot selfie in exchange for cash).

Basically, it's smartest to just take a selfie with the 'I Voted' sticker outside of the polling place or in your car.
