We had good timing on the show this week as we had U.S. Senator Ron Johnson already booked for morning after a federal judge threw out his lawsuit concerning Obamacare compliance in Congress.

In short, Roll Call explains Johnson argued the Obama administration decision to grant employer contributions for health plans purchased through the District of Columbia’s Obamacare health exchange ran afoul of the law. But a judge ruled that Johnson didn't have legal standing to bring the case because he hadn't been injured.

We asked the Senator what his next step will be in the case:

It is very difficult to take the President to court and challenge his unilateral governance...I'm inclined [to appeal the decision] because this is such an important issue here, this separation of powers, and at some point in time the judiciary has to get involved if we're going to preserve, really, the power of the Congress and check the expanding power of the President.
